Acting As A U.S. Agent Petitioner

The Modena Group can serve as the U.S. agent and petitioner for qualified artists and touring professionals seeking U.S. work visas, even when they do not have a U.S.-based employer able to file the petition.


As a small employer under filing categories with USCIS, The Modena Group may also qualify for lower government filing fees than larger employers. 


This service is commonly used by touring musicians, DJs, producers, bands, and other creative professionals who work with multiple promoters, venues, or employers.

What Is A U.S. Agent?

For artists and performer visas filed with U.S. Citizenship and Immigration Services (USCIS), a petition must be filed by a U.S.-based petitioner.


Foreign employers cannot directly file the Form I-129 petition themselves. Instead, a U.S. agent may submit the petition on their behalf.


Under immigration regulations, a U.S. agent may serve as the petitioner in several situations, including: 


  • When artists or performers are self-employed
  • When artists work with multiple U.S. employers or venues
  • When a foreign employer authorizes a U.S. agent to file the petition

Working with Multiple Employers

Many touring artists and performers work with multiple promoters, venues, or productions companies during their time in the United States.


In these situations, a U.S. immigration regulations allow a U.S. agent to file a single petition on behalf of multiple employers.


As the authorized U.S. agent, The Modena Group can submit a petition that includes multiple engagements or employers within the same filing.


This structure can help artists and touring professionals avoid the time and expense of filing separate petitions for each employer, making it a practical solution for international tours and multi-city engagements. 

Our Role in the Petition Process

While The Modena Group acts as the U.S. petitioner, we work in coordination with experienced immigration attorneys who oversee the preparation and filing of the petition.


Although The Modena Group is not a law firm, we regularly collaborate with attorneys who review and submit the Form I-129 petition to USCIS.
